Terms of Service

Preamble

These Terms of Service (hereinafter "ToS") govern the use of the HelloWeSign platform (hereinafter "the Platform"), published by [COMPANY NAME TO BE COMPLETED].

Using the Platform implies full and complete acceptance of these ToS. If you do not accept these terms, please do not use the Platform.

Article 1 - Purpose

HelloWeSign is a SaaS (Software as a Service) platform for Simple Electronic Signatures (SES) compliant with the eIDAS regulation, including:

  • Creating electronic signature requests
  • Managing multiple signers per document
  • Identity verification via OTP code (email or SMS)
  • Automatic generation of proof documents
  • Complete signature traceability
  • Access to a REST API for integration

Article 2 - Platform access

The Platform is open to any professional wishing to use our electronic signature services.

Registration requires creating an account with a valid email address. A credit system governs the use of signature features.

Article 3 - User account

3.1 Account creation

To access the Platform, the user must create an account by providing accurate and up-to-date information. The user agrees to maintain the confidentiality of their login credentials.

3.2 Credits

Each user has a number of credits according to their plan. One credit corresponds to one signature request. Credits are renewed monthly according to the subscribed plan.

3.3 Suspension and termination

HelloWeSign reserves the right to suspend or terminate an account in case of non-compliance with these ToS or fraudulent use of the Platform.

Article 4 - Data protection

HelloWeSign is committed to protecting personal data in compliance with the General Data Protection Regulation (GDPR) and applicable data protection laws.

Uploaded documents are stored securely and can be deleted at any time by the user.

Article 5 - Legal value of signatures

Electronic signatures created via HelloWeSign are Simple Electronic Signatures (SES) compliant with the eIDAS regulation (EU Regulation No. 910/2014).

In accordance with Article 1366 of the French Civil Code, electronic writing has the same evidentiary value as writing on paper, provided that the person from whom it originates can be duly identified and that it is established and stored under conditions that guarantee its integrity.

HelloWeSign automatically generates a proof document for each completed signature, ensuring the traceability and integrity of the signing process.

Article 6 - Intellectual property

The Platform and all its content (texts, images, logos, source code, etc.) are the exclusive property of HelloWeSign and are protected by intellectual property laws.

Any unauthorized reproduction, representation, modification or exploitation of all or part of the Platform is prohibited and would constitute an infringement under intellectual property law.

Article 7 - User obligations

The user agrees to:

  • Use the Platform in accordance with its purpose and these ToS
  • Not infringe on the rights of third parties
  • Not upload illegal or malicious documents
  • Not attempt to access parts of the Platform to which they do not have access
  • Not use the Platform for illegal or fraudulent purposes
  • Ensure that signers have consented to receiving signature requests
  • Keep their account information up to date

Article 8 - Limitation of liability

HelloWeSign makes every effort to ensure the availability and security of the Platform. However, HelloWeSign cannot guarantee continuous and uninterrupted availability.

HelloWeSign shall not be held liable for direct or indirect damages resulting from the use or inability to use the Platform, except in cases of gross negligence or intentional misconduct.

Article 9 - Modification of ToS

HelloWeSign reserves the right to modify these ToS at any time. Users will be informed of any significant modification. Continued use of the Platform after modification constitutes acceptance of the new ToS.

Article 10 - Applicable law and jurisdiction

These ToS are governed by French law.

In the event of a dispute, the parties will endeavor to find an amicable solution. Failing that, any dispute relating to the interpretation or execution of these ToS will be brought before the competent courts.
